Terms of Service (TOS) If an account is used to violate our TOS, we reserve the right to terminate the service without notice. The client understands that change to the TOS by HostCheckout shall not be grounds for early contract termination or nonpayment. The following constitute violations of this TOS: HOSTCHECKOUT SOLUTIONS - USE Email on File: If the email you supply us for administration contact is not current or fails for whatever reason when we try to contact you, your account will be under risk of being terminated. (See contact policies below) Illegal use: HostCheckout Internet Solution's services may not be used for illegal purposes, or in support of illegal activities. HostCheckout reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing. Harm to minors: Use of the HostCheckout Internet Solution service to harm, or attempt to harm, minors in any way, including, but not limited to child pornography. Threats: Use of the HostCheckout Internet Solution service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property. Harassment: Use of the HostCheckout Internet Solution service to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another.Fraudulent activity: Use of HostCheckout Internet Solution service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as "pyramid schemes," "ponzi schemes," and "chain letters." Forgery or impersonation: Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous emailers or nicknames does not constitute impersonation. Unsolicited commercial e-mail (UCE)/ Unsolicited bulk e-mail (SPAM): Use of the HostCheckout Internet Solution service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type will result in the immediate termination of the offending HostCheckout Internet Solution account. Content. Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right: Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated. This includes warez, roms, mp3's, mpegs, or anything else that might violate one or more of these laws. SECURITY ** (** This section targets use within our shared and reseller solutions. Other than anything marking illegal activity in the following this section does not apply to any dedicated server solutions we offer.) Gameservers are strictly not allowed to be run off any shared or reseller accounts. Due to the high level of stress this puts on the system you will need to purchase a semi-dedicated or dedicated server for this.This also includes such scripts as PTC (Paid to Click) scripts, PTR (Paid to Read) or Surfing (auto/manual surf, paid to surf etc) Sites. Again, this puts an excessive strain on the servers' resources. If you are in any doubt about what we accept in the form of scripts running on the server, please email to ask and check first before purchasing and uploading such scripts. Mirror sites and or mirrored files are not allowed on the server. HostCheckout shared and reseller accounts operate on shared resources. Excessive use or abuse of these shared network resources by one customer may have a negative impact on all other customers. Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination or suspension of your account. You are prohibited from excessive consumption of resources, including CPU time, memory, bandwidth, disk space, and session time. You may not use resource-intensive programs which negatively impact other customers or the performances of HostCheckout systems or networks. HostCheckout reserves the right to terminate or limit such activities. Any web site that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given the option to either pay additional fees (which will depend on the resources required), reduce the resources used to an acceptable level, or upgrade its service to a Dedicated Server plan. HostCheckout shall be the sole arbiter of what is considered to be a high server usage level. Any web hosting account deemed to be adversely affecting server performance or network integrity will be shut down without prior notice. The use of server stat software is strictly prohibited by any of our resellers or their clients and can lead to any account being suspended or in case of repeat offending terminated completely. We are no longer allowing videos to be hosted on our shared or reseller plans without prior permission due to large amounts of problems associated with these files. This includes videos which are saved in other formats such as, but not limited too .zip, .rar, .ace. Streaming media is not allowed on the shared servers. If you are uploading a large amount of video files please inform our techs for we reserve the right to remove any file which we feel appears to be streaming media, this is such files including, but not only limited to .rm .wmv etc Sites that are specifically designed to offer free hosting or sites that for other reasons offer free hosting for users that are not affiliated with the company leasing space from HostCheckout is prohibited unless a prior agreement is made with HostCheckout. This agreement must contain a contract that will be used between HostCheckout's Client, and the Client's Client. This contract will ensure that they have proper identification to prevent fraudulent use. If a client of HostCheckout chooses to give an affiliate free hosting, this cannot be resold in any way, shape, or form. Customers are forbidden to resell the accounts without a prior agreement from HostCheckout Internet Solutions. Server Abuse Any attempts to undermine or cause harm to a HostCheckout server or customer are strictly prohibited. OUR COMPANY POLICIES Contact Policies: If at any time we cannot contact you through your 100% guaranteed contact email we will use the following policies. If we require that you send us a reply, if we do not receive a reply within 48hrs of sending our follow up email your account will be placed in temporary suspended mode until contact has been made. If after suspending your account, you still fail to contact us within 30days your account will be terminated completely. Note - this suspension is only a temporary precaution failsafe so that you realise something is wrong and we require you to contact us. The suspension will be reversed as soon as you make contact with us. Billing Policies: It is at HostCheckout sole discretion whether or not to refund a payment during the 14 day satisfaction guarantee if the terms of service agreement is broken or abused Refunds of payments received during the 14 day satisfaction guarantee will not be given anytime after the 14 days. All requests must be received during the 14 day period. Any request received after will not be honored. HostCheckout bills clients in 30-day. If during this period a customer cancels their account they will not receive any refund. Customers cannot put there accounts on "hold" or "delay". Customers strictly prepay for the time they use. All payments are due on the first of the month. If payment is not received Hostcheckout reserve the right to suspend your account and can delete all remaining data after 7days unless otherwise noted by our billing department. If an account is removed due to a violation we reserve the right not to refund payments. If a reseller cancels their account, it is their responsibility to cancel paypal subscriptions Service Policies: Upon accepting this TOS agreement you also accept any agreement, contract that our company makes public. These documents will be made available at all times to the public. HostCheckout reserves the right to revise, amend, or modify this TOS, our TOS (Terms of Service) and our other policies and agreements at any time and in any manner. HostCheckout is not responsible for errors of any type. We reserve the right to refuse service to anyone. Client agrees that the HostCheckout may disclose any and all client information including assigned IP numbers, account history, account use, etc. to any law enforcement agent consent or notification to the client. HostCheckout reserves the right to search through any and all files on its servers. If any files are found to break the Terms of Service Agreement we reserve the right to remove, suspend, or do anything else with these files that is found to be within our discretion. HostCheckout has the right to report any illegal data to the proper authorities. HostCheckout will be found in no way responsible for any files found on its server, which was uploaded by a customer. Customers are forbidden to share accounts. These accounts can only be owned by a single person. Support Policies: Scripting, custom installations, server upgrades, 3RD party software, software installation, software upgrades, and, modifications are not covered under our support policy and may be available at additional costs. Please contact us for further details. Modification: HostCheckout reserves the right to add, delete, or modify any provision of its Terms of Use at any time without notice. About HostCheckout Technical Support: While you can always reach our technical support team via the link on our contact page, upon setting up an account we will email you an email and name of a technical support representative that is specifically assigned to you. This allows for faster service and more personalized support. HostCheckout guarantees a response of less then 48hours. But, under nearly all circumstances, this wait will be significantly shorter. WE WILL NOT TOLERATE UNDER ANY CIRCUMSTANCES ANY ABUSIVE, INAPPROPIATE, THREATENING OR BASICALLY WRONG BEHAVIOUR AND LANGUAGE AT ANY TIME! THE PENALTY FOR THIS SORT OF BEHAVIOUR IS SEVERE!
